Especially since the question is what has been agreed upon or even better what has not been agreed upon. Because if something happens due to a fallen branch, it might also be said that the tree was not properly maintained. So yes, everything is very hypothetical... but with such things, you have already seen everything possible.

As background, we practically had to acquire this street along with the house construction and thus "acquired" this fence configuration. That means there are no agreements or anything similar with us. The legal aspect is important first. Clarification will then be with the new/old neighbors.

If a tree is obviously damaged, you should (quickly) talk to the neighbor about who will take care of it. In all other possible problem cases, it does not matter who owns the trees or the property. If a tree that appears healthy falls on your car during a storm, you have the damage. Your neighbor has nothing to do with it.

If the property belongs to the neighbor, the tree also belongs to him; therefore, the owner is liable for the damages.

Talking helps, though. Simply discuss with the neighbor who will prune the tree and how.

Since we are not in a lawyer's blog here, I do not want to deepen this discussion. But googling sometimes helps, especially on sites with a legal focus.
