That is not correct. A third party can also submit the building application and get it approved. In this respect, no problem for the owner, because the approval is granted "without prejudice to the private rights of third parties"

Ok, right. For the owner, this is not a problem - for the purchaser it might be, if they actually want to start building. And many do not realize this, because they think that with the signature on the purchase contract everything is settled. But if the purchase contract cannot be executed (for whatever reasons), the (prevented) purchaser is likely to be the one who loses out.
