What documents are required when purchasing?

Hello,

we have our notary appointment for the purchase of our house next week. Unfortunately, we are still very inexperienced in this area overall.

Which documents must the previous owner hand over to us regarding the house? Do documents from the construction phase also belong to this? Does he have to apply for the energy certificate or do we have to take care of it?

The energy certificate must already be available beforehand and the notary also confirms the handover. Everything else can become quite expensive for the seller... Regarding documents: Didn’t you already review them before the appointment?

No. I wouldn’t know which documents could be of interest there.

The floor plan, land register sheet, and cadastral map are available to us

Interesting would be, for example:
- Building permit
- Structural engineering
- Electrical acceptance
- Drainage plan
- Construction description, schedule of services
- Construction contract
- Final inspection
- Invoices

Of course, it is always also a question of how old the house is.

In case of emergency, include in the notary contract that these/essential documents will be handed over upon takeover.

After several years and possibly multiple ownership changes, there are usually no documents left. The seller is not required to keep or obtain anything.
Only the energy certificate is nowadays already a must... I recently googled that one is needed for all houses built before 1990?! That would also be a must for me as a buyer by now.
In my sale, I handed over all recent invoices from the utilities, additionally the maintenance contract for the heating system as well as the building insurance, which is taken over by the buyer.
The notary contract is sent to both parties 2 weeks before the appointment.
