Hello everyone,
I need some advice from you professionals.
I am building with a company that markets itself as a "premium company" in its segment. That means I consciously did not choose the cheapest company, as I wanted to avoid a lot of trouble afterwards. So now I have a relatively high price and still lots of problems. Now to the situation.
The company seems to have only two construction managers in all of Germany, one of whom has been assigned to us.
This company also uses subcontractors for almost every trade, which I am willing to accept as long as these works are supervised by someone.
Now to our specific case.
So far, the basement has been built and completely backfilled in the meantime. The basement company is a subcontractor. Now I happened to find out that the construction manager has not even been on site. As far as I know, there are certain construction phases during which the construction manager should definitely appear (isn’t that so???). For example, supervising the waterproofing of the basement or similar.
The house is supposed to be erected soon, and I have already been told that he will "join in by phone." That made me lose my patience. But no matter how much you complain and demand, he doesn’t care about anything. I now want to bring in an additional independent building expert who will inspect the trades because I have lost some trust. Nevertheless, I want the company to also fulfill its obligations.
Isn’t there some legal aspect that can be invoked here to force the company to carry out inspections more thoroughly?
For example, extending the warranty period in case of gross negligence or something similar? (Gross negligence, in my opinion, is precisely when someone does not fulfill their duty of care, which would also include regular inspections).
I would appreciate any information on how to handle such cases.
