If the damage really stems from the greening of the roof at that time, in my opinion it can only be a so-called hidden or concealed defect, and the warranty runs significantly longer in this case => §438 Limitation of warranty claims.

Hello construction expert, the surveyor was here......so, on the remaining roof of the terrace, meaning the area that was not built over, the insulation has “drowned” (original wording), but the substrate is apparently tight. The damage should, but does not necessarily have to be, repaired immediately. Costs for this are about 2500-3000 euros (for 12sqm). On the roof itself, all metal coverings are full of holes and need to be replaced; since we also need to partially renovate the exterior plaster, we should have this done at the same time, otherwise dirt will run down and ruin the facade. Regarding the costs: our builder went bankrupt shortly before the completion of our house. All subcontractors and sub-subcontractors are no longer reachable. We have painfully realized this already when dealing with the exterior plaster.... So, all costs that arise, we will have to pay ourselves anyway.
