Rough staking changed, excavation incorrect

We started work at our construction site two weeks ago and the surveyors were there to carry out the rough staking out. Two days later the site manager was there and did a final inspection before the groundbreaking and excavation began the next day. Now, after the excavation is finished and L-shaped stones were actually supposed to be placed at the edge, it suddenly became apparent that the rough staking out had not been left as the surveyor had done, but had been moved 5 meters forward in total. By comparing pictures from the surveyor and the site manager, it was found that someone must have tampered with the stakes strategically during those two days and moved them forward. The excavation now has to be corrected and we have to expect additional costs. My questions for now would be, first of all, has anyone else experienced this problem? And who is legally responsible now? Or does the insurance even cover this at all? The police have been notified, and a report against unknown persons is in progress.

No, no one steps in for something like that. Was there ever any trouble with the neighbors?

How do you know that no insurance helps there? No, we are a small community and in my opinion it is quite harmonious here.

Actually, this would be a case for the construction all-risk insurance [Vandalismus]. Although I am not saying that they would pay without any issues. But was the construction site nicely fenced off according to old series?

What surprises me is that none of those involved in the excavation noticed this "small" deviation of 5 meters! Is the property so huge and the house is positioned in the middle, or was no one (excavator driver, etc.) present at one of the previous meetings and had not seen the original staking out? You as the client too? Not present when the excavation was done? I would definitely report this to the construction insurance; nothing more than cancellation is possible. Quite an incredible case.
