Retaining wall 2 m high without static report?

Hello everyone,

We currently have our project with the building authority in Heidelberg and are now a bit puzzled. After 3 months of review (other things had to be submitted), the building authority is missing a structural engineering report for the planned 2 m retaining wall in the garden (which supports the terrace over 3 m length, so it does not support the house).
My architect told the building authority that no structural report is needed because up to 2 m is exempt from approval. But the building authority wants a report, which we do not have.

So what is correct?

This is stated in the respective state building code. For Thuringia, the architect's statement is correct: no approval required and no structural engineering!

Also applies to Baden Württemberg, but what to do if the building authority still requires it.?

Simply build. It's approval-free as you write.

Yes, but without the structural analysis, they will not grant the building permit for the house...

Isn't the proof from the manufacturer of the stones sufficient? Otherwise, call your structural engineer for the house.
