Hello dear community,
I just registered on the "Hausbau-Forum," skimmed through some posts that might concern me, but found nothing in my direction. I ask you for advice on the following:
In September 2010, I signed two contracts with a sales representative, one for a double patio door amounting to 5,204.08 euros and another contract for a stainless steel balcony railing amounting to 5,236.00 euros.
I got the sales representative’s phone number through a recommendation and contacted him to arrange an appointment. After he visited us and took everything down, he came back immediately and on short notice to sign the contracts. At this appointment, I told him that I would only order the patio door and wanted to agree on a six-month option for the price of the balcony railing. Being caught off guard by the timing and tricked by professional sales tactics, I signed, which I immediately regretted after the visit. The following morning, I sent a Telefax with the withdrawal from both contracts. Afterwards, I was terrorized by this sales representative by phone, though he was unable to reach me. Shortly before Christmas 2011, I received mail from him with an excessive claim of about 3,000.00 euros as compensation. After a short phone call with him, he told me that he "felt insulted by my approach and insisted on fulfilling at least one contract, for example, being able to deliver the stainless steel balcony railing." I told him that I did not have the money for that and that he would have to be patient indefinitely, after which I had some peace for a while. Half a year later, he again sent me these payment demands by registered mail, the first one was accepted by my wife, the second registered letter she was instructed by me not to accept, which she also did. Now, after two and a half years, a letter from a lawyer has come again by "normal" mail, with a renewed demand for compensation amounting to 2,926.20 euros with the threat of a court lawsuit if I do not pay.
I do not want to pay because this sales representative seemed creepy to me, I had no trust basis for business with him AND during the visit, with my wife present (as a witness), he offered part of the contract as a "black deal"! That is enough reason to withdraw from the contracts, isn’t it?
Please write to me, am I out of the contracts or do I have to pay in the end?
