Rejection of application for building plot

Dear prospective homeowners,

I would like to hear your opinion on the following matter:
A neighboring municipality has been selling building plots since 2012. Of 6 plots, 3 are still available because apparently there have not been enough applicants so far. Since we like the plots, we applied and were invited to an interview with the mayor. In this conversation, he made it clear to us that for the last 3 building plots they are looking very closely at who applies. A disadvantage could be that we do not belong to the municipality. Furthermore, we were asked whether we were members of an association. Ultimately, however, he said that the decision lies with the municipal council and he sees our chances as 50:50. The municipal council then decided to reject our application. We have not received a reason for this decision. By the way, no allocation criteria were published in advance.

Can the municipal council simply reject it like this? Can I insist on a reason?

If you re-clothe the football club, that will surely mean something. Didn’t you understand the hint from the mayor?

I am well aware that we as "outsiders" are probably not welcome. But my concern is more about the legal question. Can a municipality really make it that easy?

Well, the decision to sell should probably be left to everyone to make freely, right? It doesn't only apply to properties, but also to everyday life...

klblb hit the nail on the head.

I would kindly contact the mayor again and ask what the issue was and how the decision-making body could be persuaded. I mean, the neighboring community is usually not that far away. Also, ask which club is feeling the financial pinch the most.

Sounds intense ....basically, it’s certainly not okay, you could probably invoke the AGG (General Equal Treatment Act), but that won’t get you anywhere. 1. How are you supposed to prove something like that, the municipality can surely come up with other reasons. That’s probably also why you will never officially be given a reason by them. Because that would give you a pretext to sue. 2. What good is it to sue your way into something like that. You don’t make friends that way, especially if you might want to live there for the rest of your life. I also think the only way left is "bribery" ... to try having a personal conversation again and turn something there. For me personally, the matter would already be dead... if they apparently don’t want you there, I wouldn’t crawl up their ass over it.....
