Hello everyone,

my girlfriend and I are planning to purchase a property worth about €50,000.
Since we are unmarried and will initially pay for the property from my own capital, the question arises whether additional costs will occur due to a possible gift?

In the land register, we will both be listed at 50% each.
That means she is basically getting a gift of €25,000? The tax-free amount is only €20,000.
Am I seeing this correctly?
How can one act in this case to protect the own capital?
We will then finance the house together at some point.

Spontaneous ideas: get married or just gift a share worth 20,000 euros (she could contribute 5,000 euros). The tax in the original case would, in my opinion, be 1,500 euros.

Because she would be at a disadvantage in the event of a separation during a later house construction.

She should be listed in the land register as she will also contribute half of the financing for the house. We might then deduct the 50k and have 60% and 40% listed in the land register.

Who the money comes from is initially irrelevant in terms of the gift.

We bought a property at the beginning of the year and both of us are listed in the land register, for example, we each had to pay property transfer tax on the 50%.

In the meantime, we are married and leave everything as it is. Who the money came from is initially of no interest. If it is your wish to document that, of course you can do so in writing.
