Product liability manufacturer roof insulation - roofer insolvent

Hello, following up on the first post about the stinking roof insulation, the roofer is insolvent. But it was not our fault - probably trouble with a large contract.

The inspections and statement from the sales department of the roof insulation manufacturer showed that the work was done correctly, but the roof insulation smells like cat pee when it is cut. However, since the condition should subside according to the manufacturer and it does not, am I correct in assuming that the manufacturer is liable to us for the product?

You will never be able to get such a question answered with a yes or no. There are a number of prerequisites for examining a claim under the Product Liability Act. Since life and limb are evidently (still) not harmed here, the next step would be to check whether any damage has occurred that cannot be the actual product. Apparently not. With the information provided here, liability under the Product Liability Act is therefore excluded due to the lack of a relevant legal basis. The short version would be: you are not correct in your assumption. ;-)
