Good day,

a few days ago I came across the topic of processing fees for loans, which apparently cannot be charged at all. Now, what about the Baupsr instant loans? Here, the reported loan amount is listed in the Schufa entry, so processing fees shouldn't be charged here either, right? Then, about a year ago I had interim financing for the house construction. That has already been repaid. But the contract also mentioned "Wertermittlungskosten" (valuation costs). Those aren't legal either, are they?

Maybe someone can clarify this for me.

Valuation costs are not processing fees.

What is a [Bausparsofortdarlehen]? And what exactly were fees charged for? For the loan or for the associated [Bausparvertrag]?

An immediate home loan savings is basically a home savings contract where you get the loan immediately. That means the savings phase comes afterwards. In the contract, which is literally called "loan agreement" here, it only says "loan fee" and not processing fee; I believe that is an important difference. For the other bridge loan and the "valuation costs," as I have read, these are also not supposed to be passed on to the customer.

It is and remains a home savings contract and a pre-financing. Two basically separate contracts to begin with, presumably a loan without repayment, but with a repayment substitute service. Where exactly does the fee come into play? I can't really assess that.


Aha, what did you read, where did you read it, and in what context? Were you given the result of the valuation? Then the fee is initially to be considered separate from the loan, since it is a service from which you yourself clearly benefit. There is an older judgment somewhere where valuation costs were not accepted, but that was only because the bank determined the value and kept this value to itself. But as soon as you also learn this value, the bank is out. Because as a (usually more expensive) alternative, you could also have commissioned a market value appraisal from an external third party, and the bank has no work with that.

The loan agreement only says "processing fees," sorry, not loan fees. But not a word about completion fees, which would be legally binding.

And regarding the valuation costs, you can find information everywhere on Google.

Very one-sidedly written and only illuminates one side of the coin. However, this was to be expected from the Verbraucherzentrale.

Tax costs as a service for the customer are not affected by these rulings.

It is fundamentally up to the borrower to demonstrate the value.

So the customer can also provide an appraisal at their own expense.

The tax costs of a bank are significantly lower than any independent appraisal.
