Postponed street drainage - still pave?

Hello everyone!

Maybe someone from the experienced forum members can help me. In our new development area, the street drain is shifted and partly lies on our property boundary, which is going to be paved. The development company has promised to fix the error, but nothing is happening (reminded them several times, but nobody there cares). If we were to pave, I would have to cover about half of the drain. Can I still do that or will I get into trouble with the municipality because I am restricting the rainwater drainage?

Simply doing it is rarely good. Call the responsible caseworker at the municipality and ask. If the development company does not clear your property, you can threaten legal action and, if necessary, carry it out. Sometimes a letterhead from a lawyer works wonders. However, if the purchase contract contains an agreement regarding the development carrier, it may be that you simply have to wait :(. We had a different case: For us, no road surface was planned at all (about 2 sqm after the path to the street). We have now paved this public property area ourselves – but only after consulting with the municipality. A brief inquiry there was enough.

Thank you Wastl! A lawyer costs money, promises a lot and usually brings nothing (have experienced this several times in my circle of friends). The municipality knows the problem and refers to the developer (the road has not yet been approved). Therefore, my idea is to simply "clear" my land on my own. The developer has had plenty of time to "take care" of the problem.

Registered letter with a one-week deadline to the development agency stating that they must clear your property, otherwise you will clear it at their expense. Maybe it will help?
