planned house near a railway line

Hello everyone,

I have a special question for you, namely behind my property there is a railway line on an embankment about 15m high with freight and passenger transport.

On the other side of the railway embankment is a new residential area that has been given a noise protection wall.

Because of this, I find it significantly louder on my side, as in my opinion the sound is reflected back.

The planning of the new house stipulates that it will be about 30m away from the railway line.

Now my question:

Do I have a claim against the railway company to reimburse the costs for more expensive soundproof windows in the bedrooms?

Although I am not a lawyer, why should the railway company pay you anything? Are you forced to build there? If not and the railway company is too loud for you, build elsewhere. It is provocative, but that will probably also be the legal opinion. It would be different if you already lived there and the railway company (for whatever reason) became louder at your place after completion of works (e.g. the noise barrier on the other side of the tracks) (but there will certainly be legal provisions for that).

15m high railway embankment? I can hardly believe that, or are you building your house right at the foot of the mountain?

15 meters corresponds to the height of a 5-story building!

I can hardly estimate how high it is, I would just guess 10-15m.

Unfortunately, I just saw it myself, it only applies to houses built before [1985].
