Payment of the final installment after assurance of defect rectification

The final installment amounts to 7,500 euros, I will call the expert directly tomorrow and ask about it.

It was not agreed upon, but it will be added to my list of things to consider for the next house construction ;)

What kind of contract is it anyway? According to the Building Code or according to the VOB? "Due after acceptance of the construction" sounds to me like the Building Code, where no retention is regulated, see "due after acceptance of the construction"... that is a regulation and not a saying!

Even with the agreement "due after acceptance," the client is entitled to raise the objection of defect, so that the contractor usually cannot enforce his claim. This also applies to fixed agreed payments according to the payment schedule.

641 para. 3 Baugesetzbuch provides the answer.
