No building land, but an old existing house in the landscape protection area

Hello everyone,

in a landscape protection area in Munich lived an elderly couple, who unfortunately have now passed away, in a house (approx. 60 sqm floor area) on a very large plot of land. The house was built sometime between the 1st and 2nd World War and has an electricity connection. The land is not building land. The house is very rundown, but it is still standing. Allegedly it is an "illegal building" that was subsequently approved or tolerated. On the property there is also a roughly 150 sqm (masonry) shed, which so far housed a woodworking shop. Since it is near my family, I am interested in the property and wonder what can be done with it.

A prerequisite for me would be: I would completely rebuild the house (could stick to the existing floor area) but would want to convert the attic and add a basement underneath. Ultimately, I ask myself: what can be legally achieved here? In its current condition, surely no buyer will be found, but you can’t just let the property and the little house decay – at least I don’t think that is in the interest of the City of Munich.

However, I am not yet familiar with the subject and hope to get some advice and tips.

In the interest of the city of Munich? The house is located in a landscape protection area. The purpose of a landscape protection area is not to have any construction, but to preserve the landscape. That is why the area was designated. So it is initially in the interest of the city to get the house removed from there. The house will probably have grandfathering protection. To what extent this applies to a renovation, expansion, etc., I do not know. I think that an expansion would have to be approved and you will have a hard time with that. If you do it without approval, the city can force you to demolish it? That could be very risky. I can only recommend - call the responsible building authority before buying the plot and try to get a feel for the mood. If the caseworker doesn’t say anything to you, you can also submit a preliminary building inquiry for a different plot and only buy it once the municipal council/city council has approved the preliminary inquiry. PS: Which landscape protection area are you talking about?

Do not call, walk by. And demand every statement in writing. Oral statements from the building authority clerk are worthless. In the end, you are the one who gets screwed :)
