Level the hanging plot, no mountain on the house?

Hello everyone,

maybe I am lucky and there is someone here who had the same problem and can help me.

We plan to start building the house in the next 2-3 months. We have a beautiful plot on a slope that has been in the family for a long time, so it was clear that we would build there. Size about 1300 m², width about 30 m, it gets wider downhill. Above is the street and also sometimes the driveway, then the plot slopes down and below there is nothing else (except lake, meadow, forest...)

It is supposed to be a "normal" single-family house with a connection to the garage. NOT a direct hillside house.

Now last week we decided where the house should stand and the heights were leveled.

We are 6 meters away from the sidewalk above. For the terrace below we have to fill about 2 m, but that can all be done. The rest of the property can also be designed so that it is okay.

The problem: We keep the distance between our garage and the neighbor’s barn in the east at 3 m. But we are about 1.5 - 1.8 m HIGHER than the neighbor’s house. Further to the west we cannot and do not want to go, because with 6.5 m garage, 2 m passage, and 11 m house, so with a total width of about 20 meters, it would be quite tight on the west side.

How can I adjust these 3 meters to the neighbor’s house so that it doesn’t look like we built our house on a mountain?!?!? We are totally clueless... Can someone give us a tip? So we have to compensate about 1.8 meters of height difference within 3 meters.

I am grateful for every tip and hope one can understand somewhat what I am talking about here

Hello Dandan,

Fillings are considered independent structural components under building regulations, meaning that the filling itself must have a boundary distance of 3m at its base or trigger a distance surface easement on the neighboring property. The garage itself is - as far as I can judge from here - not a problem if the narrow side privilege can be applied on the eastern boundary side.

Be sure to consult your architect/planner about this.

To my knowledge, you could then slope towards the neighbor. However, the angle must not be greater than 45 degrees. So if you are 1.50m above the neighbor's ground level, you would have to start sloping at the latest from 1.50m distance to their boundary.

... and then only 1.50 m distance remains from the foot of the slope to the boundary. The minimum boundary distance without an additional registration is usually 3.0 m. Therefore: definitely consult an architect/planner to find out if the slope/garage can be built like this (possibly with the neighbor's consent).
