Is this considered equity/security at the bank?

Hello,

we have found out that the two-family house is registered or runs as a community of owners between my wife and her brother. In other words, one apartment (value approx. 120,000 euros) belongs to us and the other apartment (value approx. 70,000 euros) belongs to her brother. Is it possible to declare our part or her apartment as equity to the bank at all if the entire house runs as a community of owners?

Providing security to the bank means that a land charge or mortgage is registered in the land register in favor of the bank. If there is "only" one land register (e.g. single-family house, two-family house, multi-family house, ...), the land charge encumbers the entire property. If your property consists of several residential land registers (e.g. condominiums), each apartment can individually serve as security to the bank.
