Hello,
we are currently in the process of building a house and are waiting for our utility connections. In the original plan, a right of way for walking, driving, and utility lines is provided at the right property boundary. From there, the utility lines should then be routed along each house on the property to the back of the respective house. This is how the utility lines were also drawn in an original plan by the construction company. We are the foremost property on the street. However, the utility provider now only wants to lay the lines for the rear property owners along the right side utility right of way. For our own property, they indicated that the lines will be laid along the right edge of the property. We do not want this for several reasons: - originally, no lines were planned here and due to space reasons (the property is very small), we want to set up a playground, a garden shed, and possibly an underground rainwater barrel on the side where the lines are now supposed to be laid. Except for the rainwater barrel, this would still be possible, but of course the existing structures would be endangered once the utility provider needs access to the lines. - to lay the manhole for the lines, our fence and a noise protection wall with a stable foundation would have to be removed and undermined. We purchased the property including the fence. The existing structures would also be endangered here. - the location of the lines outside the utility right of way was not recorded by notary deed but significantly restricts the use and, in our opinion, also the value of the property. The reason for the line location indicated by the utility provider is apparently that there is a closer external supply point on the left side of the property and they want to avoid the effort of a longer line on the left side. What options do we have to insist on the right-side location, as originally planned? Thanks in advance for your help!
