Hello,
we have a corner plot and I would like to set up a pergola perpendicular to the boundary with an adjacent street. For better clarity, I have a screenshot from a 3D program. (Pergola in red, plot in gray, 3m boundary development blue line) The minimum distance to the boundary is approximately 0.5m, probably even a bit more.
According to the state building code for Schleswig Holstein:

Now the question: Am I allowed to put the pergola there? Is the pergola allowed to have a small metal roof and thus become a "seating area"? What height is permitted and from where is it measured? Our plot is already significantly higher than the street. If measured from the street, no one would be able to walk under the pergola anymore.

§ 6
Setback areas, distances
(1) Setback areas must be kept clear in front of the exterior walls of above-ground buildings. Sentence 1 applies accordingly to other installations that have effects like buildings with respect to buildings and property boundaries. Effects like buildings particularly arise if they are longer than 5 m and higher than 2 m, with terraces if they are higher than 1 m. A setback area is not required in front of exterior walls built on property boundaries if, according to planning regulations, construction must or may be carried out on the boundary.

(8) In the setback areas as well as without their own setback areas, small children's playgrounds, uncovered bicycle storage facilities, swimming pools, masts, terraces, pergolas and coverings of seating areas, as well as subordinate structures such as open enclosures, are permitted.
