Is a penthouse allowed if the development plan requires a flat roof?

Hello everyone,

I have a question about the interpretation of a development plan. If the development plan states "II FD", meaning two full stories, flat roof, is then a setback floor, which of course is not a full story, permitted?

The setback floor would naturally have a flat roof. Up to what pitch is a roof actually considered a flat roof?

If a flat roof is explicitly required and, for example, the floor area ratio is 0.2 and the plot ratio is 0.5, then this already indicates this possibility.

The distinction between flat roof / shed roof in degrees can possibly be found in the textual provisions; I would not dream of anything above ten degrees.

Conversely, this also means: the roof cannot have more "slope". This makes the eaves height a particularly critical dimension.

Wouldn't one have to read it like this: whoever builds 2 full floors must then take a flat roof. So that the houses do not become too tall. But whoever is satisfied with 1 or 1.5 can also have a gable. I really can't imagine that a [B Plan] flat roof, which is the most problematic roof type, is strictly mandatory. Karsten

a) then it would have to say II FD/SD b) didn't you yourself talk about a development plan area with themed quarters, where flat roofs would belong to "Bauhaus" (Hornbach style)?

Only flat roofs are allowed here because the settlement is supposed to appear in the Bauhaus style. Further design specifications support this. What could be problematic about flat roofs? Take a look at inverted roofs. Nowadays, the waterproofing is no longer exposed to the weather in such a way, and the top layer can be made just as watertight as in basement construction (WU concrete).

Here the same, only flat roofs and at least 2 full stories allowed. I don't understand what could be problematic about flat roofs. Our developer builds gable and flat roofs and considers the latter to be less problematic.
