Interior plaster poorly repaired by painter

Hello,

our newly built single-family house was plastered a few months ago. A rough plaster was applied. I really thought the workmanship was excellent. Unfortunately, the craftsmen of the subsequent trades left damage on the plaster in the form of dents and scratches.
The stairwell was hit the worst. The painter has now repaired these spots, but it looks like the plaster texture was not restored, but rather smoothed over. Now these spots are very noticeable, of course. I do not like this at all.

Does this constitute a defect? Can the plaster texture be restored?

Of course it can. The damaged areas would need to be generously scraped off and then plastered with the originally used rough plaster (not with Rotband or similar), structured and smoothed to the grain size. The painter is simply not a plasterer, and for him, repairing automatically means smoothing with filler. But if he cannot fix his damages himself, then a plasterer must do it, who will be paid by him.

If he were to break a glass pane, smoothing it over would not help either, and another trade would have to repair his damages – of course at his expense.
