How to proceed to avoid pitfalls when buying property

Hello,

a friend of my father is planning to sell about 500 sqm of his total 1000 sqm property within the next few months. In a second step, some time later, he wants to sell the other part, on which the house stands where he currently still lives, including the house, and move into an age-appropriate apartment. The property, as it is now, is relatively elongated, so it can be nicely divided into 2 approximately square parts. The elderly gentleman is just as inexperienced as I am. How do you proceed to get this done smoothly? Inquiry whether a second house would even be approved there? Surveying to then draw the new boundary?

So clearly the first step would probably be to clarify whether a division of the property and further development is even possible. If this is not possible for whatever reasons, a lot of things are resolved by themselves. Therefore, this should be the first step; if a division is possible, the details can also be clarified directly. And then it would have to be divided and both properties newly surveyed.

1) Clarify whether building rights exist. 2) Survey, divide, declaration of partition at the notary. 3) Sale through the notary. You can privately share the costs of 1) and 2) if the transaction is successful.

The access for the rear part also needs to be clarified. It will then be a long, narrow plot of land. Basically, the building authority is the best contact for all these questions and clarifications for the first step.

The longer side of the property runs along the street, so you can simply divide it at a right angle to the street and more or less get 2 equivalent plots of land each with direct access from the street. Then I will probably contact the building authority, or tell the owner that he has to do it.

You can do that. However, the partition must be initiated by him.
