How is it regarding a gifted plot of land with house construction?

Hello everyone,

my girlfriend and I would like to build soon. She is receiving a piece of land as a gift from her parents and will then be registered in the land register. What does it look like when we build the house? Can I also be registered together with her in the land register for the house, or is that not possible? I have some concerns that I cannot be entered in the land register because the land belongs to her. Do I have any disadvantages because of this?

Hello, of course you should be in the land register if the actual house construction is financed and you are also the borrower. It would be fatal if that were not the case. You should only find an arrangement in case of a separation.

Can I be entered in the land register for the house if my girlfriend is the only one listed in the land register for the property?

If you go to the notary and sign the corresponding agreements, you can even be entered alone in the land register. However, costs for the notary as well as property transfer tax will be incurred.

So that means the property can belong to my girlfriend and we can both be listed in the land register for the house

As mentioned, the separation of who owns how much of the house + land must be regulated separately by a notarial contract... The land register will never state girlfriend = land, boyfriend + girlfriend = house
