House construction on a plot

Hello,

we have purchased a plot of land that consists of 2 parts. The upper part is perfectly flat and huge, the lower part is slightly sloping and narrower. Now we have learned that on the lower part, exactly at the border to the neighboring property, there used to be a small residential house, which was demolished years ago. We were told that the authorities might insist that we rebuild our new house at the same location. However, this would not be possible according to the new building regulations, since, as mentioned, it was directly on the neighboring property. Right?
Is there possibly a statute of limitations here?

is there a development plan for the property?

Or is the building permitted according to §34?

Are there possibly a building envelope or even just building lines?

Hello Angel77,

Doc.Schnaggels has already asked the right questions. I suspect that you have been confronted with dangerous half-knowledge, because basically, current planning law always applies to new construction. What was once stated somewhere in the past is legally basically irrelevant.

The location of the old building is not so crucial, but possibly that of the neighboring houses.

For example, if all the houses in the area are located on the street side and have a large garden at the back, you may not be allowed to place the house at the back on your property but must place it at the front by the street.

Does this also apply if the old house was demolished without permission?

: As I learned last year, you no longer need a permit in BW to demolish a single-family house.

The head of the building authority explained to me that recently in BW, demolition without a permit is allowed – only when demolishing one half of a semi-detached house must the owner of the other half be informed in writing.

Hard to believe, but there is actually less bureaucracy here now...
