Hedge cutting despite breeding and nesting season

Hello,

I need to create an access road to my building plot. Unfortunately, the plot is completely surrounded by a hedge. Since construction is scheduled to begin around July, we are still in the breeding and nesting season. Can I simply cut a 4m wide gap in the hedge to provide trucks access to the plot? Does anyone know what the legal regulations are?

That depends on the state/municipality. For example, we have fruit trees and hedges on the property, and we are definitely not allowed to touch them as long as we do not have a building permit and an additionally approved application from the [Grünamt]. The [Grünamt] does approve it, but unfortunately not before the building permit. It must also be certain that there is no other option. The application may also cost money (in our case 120€/tree). Do you own the hedge and is it on your property? For us, the office even came out to see what the property looks like... they are really on top of it here! If you get caught with an unauthorized "cutting down," a 50,000€ fine can await you :confused: But, as I said: it’s best to ask at the [Grünamt], but it also always depends on which neighbors you have, whether anyone even cares...

The hedge should actually not be so impenetrable that it would be difficult for the zuständigen expert to clearly recognize its uninhabited status. If it is currently being nested in, then you will be out of luck; at least at that spot, it won't be possible.

Lower landscape maintenance is typically the responsibility of district administrations. They must be able to tell you what you (are not) allowed to do and who assesses this. Foresters and tree care specialists also know the details. Lay opinions will not get you any further.
