Groundwater lowering - which liability insurance?

Hello dear home builders,

we are planning the new construction of a single-family house with a basement with a developer on our property. The plot is quite narrow and the neighboring plots are also developed. For the basement construction, a groundwater lowering is required, as well as securing evidence at the neighboring houses. So far, so good.

But who is liable if damage occurs to the neighboring buildings even though no one can be proven to have acted wrongly? Does anyone know an insurance that covers this risk? Allianz, Axa, HUK and Alte Leipziger I have already checked... their builders’ liability insurance excludes this :-(

Please no tips telling me to do without the basement

If you cannot be proven to have made a mistake, there is no liability insurance coverage either. Most then turn into a kind of legal protection and reject the claim. Why should the construction company / its liability insurance not be responsible for its actions?

Your property or developer? Both at the same time is not possible and is not entirely irrelevant for answering the question.

Our property. We are commissioning demolition of existing buildings, groundwater lowering, and new construction separately.
