Garden soil compacted during new construction - Does this constitute a defect?

Good day,

Last year, I purchased an apartment under construction with a garden area. According to the construction description, the garden is to be filled with topsoil. This was done a few weeks ago. Before the filling, the substrate was apparently not loosened. In a few days, the final acceptance of the property is scheduled.

Since I have not found anything during my research so far, I now have two questions:

    [*]The construction description only states "filling." In reality, this is about 20 cm. Is that enough or would more be necessary? What is owed if not further specified?
    [*]After filling, a compact loader drove over the ground several times to fill gabions. The soil is now obviously heavily compacted and water stands for days (north side) approximately where the loader drove. Is this a defect? In other words, can I expect or demand a loosening of the soil?

IMHO: Appropriate to the surroundings. If you buy a 100 m deep crater with the addition "fill up," 100 m will be filled. If you buy a property where a little something is missing, a little something will be filled.

IMHO yes, but... I guess that after 2 to 3 years of litigation, which will have cost you between 2,500 and 10,000 euros, you will get about next to nothing as damages. Pragmatic best(?) advice: Politely but insistently ask the party responsible to occasionally loosen it again with the excavator bucket. Or till it yourself. I guess the loader only compacted it superficially.

Rent a rotary tiller and do it yourself....

A tiller costs about 35 e / day with us..... That’s not worth it to me

How about sowing? Is that included in the price? If not, do everything yourself and quickly. Now is the ideal time to make the lawn

I wouldn't call that a defect now, you can handle that yourself...
