Hello forum!
We are very fortunate to be able to buy the plot of land behind us.
We are located in Brandenburg.
Under Wünsdorfer Sonnengärten you can view the development plan – our plot is located in WA 1 in the north, directly west next to WA 5.
I am also attaching a Geoportal image.
Our parcel is number 1827, our building plot. Above it lies parcel 1828. It will be divided. All the adjoining plots are offered it as a purchase option (so anyone can buy the piece behind their own plot).
We do not yet have a contract. However, the plot is being sold (wording by the seller) as forest land for 5 euros per sqm.
There is a land use plan from 2018 that designates the entire plot as residential building area. The plot borders a designated landscape protection area (forest). However, the development plan (which is older than the land use plan) specifies the area as "Forest §9 (1) 18b Federal Building Code". As part of the development of the development plan area, the land seller had a larger strip of the trees in the forest area felled for fire protection reasons (with compensatory planting elsewhere).
Questions:
What applies now: residential building area according to the land use plan or forest according to the development plan?
Is it allowed to put up a small garden shed on the area? Would one even get a building permit for this (due to possible habitable space) in such a designated area?
Access to the plot is only possible via the (own) southern plot.
And one more question about property tax: Does it not matter for property tax whether the area is "forest" according to the development plan, and is it simply calculated with property tax B?
