Hello forum!
We are very fortunate to be able to buy the plot of land behind us.
We are located in Brandenburg.
Under Wünsdorfer Sonnengärten you can view the development plan – our plot is located in WA 1 in the north, directly west next to WA 5.
I am also attaching a Geoportal image.



Our parcel is number 1827, our building plot. Above it lies parcel 1828. It will be divided. All the adjoining plots are offered it as a purchase option (so anyone can buy the piece behind their own plot).

We do not yet have a contract. However, the plot is being sold (wording by the seller) as forest land for 5 euros per sqm.

There is a land use plan from 2018 that designates the entire plot as residential building area. The plot borders a designated landscape protection area (forest). However, the development plan (which is older than the land use plan) specifies the area as "Forest §9 (1) 18b Federal Building Code". As part of the development of the development plan area, the land seller had a larger strip of the trees in the forest area felled for fire protection reasons (with compensatory planting elsewhere).

Questions:
What applies now: residential building area according to the land use plan or forest according to the development plan?

Is it allowed to put up a small garden shed on the area? Would one even get a building permit for this (due to possible habitable space) in such a designated area?
Access to the plot is only possible via the (own) southern plot.

And one more question about property tax: Does it not matter for property tax whether the area is "forest" according to the development plan, and is it simply calculated with property tax B?

So forest is outdoor area (§35), house property is indoor area (§34).

There is no property tax on land and forestry properties in the outdoor area. therefore cost-neutral. Building without permission in the outdoor area is not allowed. No garden shed, no garage, not even a fixed pavilion. I believe a shelter hut is allowed to be built on it. Otherwise, everything must be applied for.

The price of 5 euros per sqm is already very expensive. Maybe justified if the area is smaller. Now it depends on whether surveying and costs for subdivision, etc. will be added. Forest areas normal price about 1-2 euros.

Still buy. That way you always have peace from behind, can still create a garden, etc.

Nowadays there are apparently also legal changes that are supposed to facilitate building in the outdoor area if these properties border the indoor area.

I would buy it if you can afford it. You have quite a few plans for the garden area anyway. For a BG obligation, the piece of forest is too small. Is it even properly forested or more of a green area?

If the money is there, buy! There's nothing more beautiful than an unobstructable forest by the house.

The area is "only" 564 sqm, so in terms of price it's great for us, even if it might be too expensive in general.
So you mean we can trust the development plan and assume that it is evaluated according to §35?

We are aware that we need a permit, but thanks! It could have been that it was hopeless to get a permit.



It is 564 sqm, with a small strip of forest with about 40 trees in the north.
So it’s half forest edge and half green space.
Do you think the property is too small to be outside area? Because of BG obligation?
