Hello everyone,
As is well known, when an older house changes ownership, there are various renovation obligations, which also include the insulation of the roof, provided the living space is directly adjacent to it.
Now, in §47 paragraph 2 of the [Gebäudeenergiegesetz] there is an exception (or rather a mitigation of the obligation) in the case:
"Wird der Wärmeschutz nach Absatz 1 Satz 2 als Zwischensparrendämmung ausgeführt und ist die Dämmschichtdicke wegen einer innenseitigen Bekleidung oder der Sparrenhöhe begrenzt..."
This exception is frequently used for pitched roofs and is also widely discussed on the internet.
But what applies to flat roofs? Their insulation cannot (in my understanding) be equated with an insulation between rafters, as paragraph 2 would literally apply.
But are there also any exceptions there? Or must the 0.24 W/m²K specified in §47 paragraph 1 fundamentally be complied with in the case of an old flat roof?
Important: Even though my question contains some paragraphs, I obviously do not expect legal advice. Perhaps some of you have bought, inherited, or renovated a house with an old flat roof and have dealt with this question?
