First height like neighboring buildings

Hello dear home builders,

we are possibly planning to start building a self-owned home this year. Originally, I wanted to build a 145 sqm single-family house with a mono-pitched roof with a 25° incline to have as much area as possible for a photovoltaic system. However, we want a raw building height of 2.80 m on the ground floor and upper floor, and despite a knee wall of 1.70 m, I come to a height of over 11 m. Because of this, we decided to change the mono-pitched roof to a single-ridge gable roof. However, I still come to a ridge height of about 9.70 m. Within a radius of 300 m there are at least 3 houses (one of which is only 3 properties away) that are verifiably higher than 10 m. After our house construction company made initial contact with the urban development planning office, we were informed, after reviewing their documents, that the house height of the building 3 properties away is below 10 m. On site, the homeowner was so kind to measure and determined a height of about 10.10 m. Now my question: does a building inquiry regarding house height still need to be submitted, or do the city or state have the right to tell me that I may not exceed a height of 9 m?

The situation is not comprehensible; however, the description suggests that significantly more information was exchanged in the communication with the building permit authority than is disclosed here. I will respond assuming that the construction project must blend into the immediate surroundings according to §34 of the Building Code. The decisive factor for the extent of structural use, which includes the number of floors and the eaves and ridge heights, is initially the buildings immediately adjacent to the building plot. In cases of particularly varying neighboring buildings, the environment can then be expanded. The designer must submit a detailed documentation of the surrounding development with the absolute heights above a uniform reference level, ideally the official one, which is also bindingly prescribed in NRW by the [BauPrüfVO], either with the preliminary building inquiry or the building application. Based on this plan and a meaningful photographic documentation, the designer can convincingly demonstrate how their planning fits in. The approval authority then examines whether the conclusions comply with the regulations. If there are serious doubts about the accuracy of the submitted documents, the authority must justify this, for example, by consulting the building file of the disputed building. Now the question arises to me initially how the statements about the contradictory building heights came about at all. Who determined which measurement with what expertise and how?

1. which federal state, due to the different state building codes
2. Is there a development plan or not?
3. Size of the city, to know who the approval authority is
