Final road construction: Possible defects and procedure?

In our new development area, the final construction phase of the so-called construction road is currently underway. That means sidewalks, curbstones, and road surface...

The company that won the contract apparently subcontracted the paving work to a sub who delivered suboptimal results. The flow of information is currently generally poor as a result.

There is talk of a construction stop (which is currently sporadically the case), surveyors, and blah blah blah.

As a resident, do I have any options to complain or withhold payment if the payment request from the municipality should come?

Today I come home and the street or gutter is marked with spray; is this stuff going to be removed anyway? If not, then at the latest now that it’s ruined with neon spray, right?

Attached are a few pictures; is it actually normal to change the paving pattern twice within 15 linear meters? Even if it’s a curve?

I don’t want to be a picky troublemaker who complains about everything, but this isn’t normal, is it? Especially since none of this would be an issue if mistakes were made and talked about openly? But so far there is only hallway gossip among the residents.

I see you here purely as a fee debtor, without any legitimacy for a quality assessment or any leverage to ensure the remedy of complaints. In my opinion, you are in no way a creditor of the (sub)contractor’s services, and also not authorized to influence the client, to "push" the contractor, demand a price reduction, or similar [private opinion of a businessman but not a lawyer, no legal advice].

What does the community say about it? They will surely have someone responsible for the project. Maybe everyone should just send an email to the department, the AP. If 10-20 complaint emails arrive there, something might happen and someone might come to take a look.

Well, always stay relaxed.

The municipality as a corporation and the commissioned engineering office, etc., etc., will certainly point out the defects and insist on repair/elimination by the contractor. Whether during the construction phase or during the normal acceptance of the new development area. Completely normal procedure and common practice....

So, as a regular property owner, you have nothing to do with it and would rather chill on your new terrace with a cold drink ;-) ...[sofern schon vorhanden]
