In the chapter "Hinweise" the following passage can be found: "Agreements not notarized are ineffective and can lead to the nullity of the entire contract (§311 b Abs. 1 Baugesetzbuch)".
Then the legal side is clear – to your disadvantage. The remaining issue is how you want to solve this technically.
