Yep, clear case of the notary dropping the ball. Without the negative certificate, he shouldn’t have sent the notification regarding the due condition. Did you pay for the house yourself? If a bank were involved, it wouldn’t have disbursed anything without holding the negative certificate. Please keep us posted, interesting case.

I see it that way now too, I just spoke with a construction law attorney to be on the safe side...

The property itself is 100% self-financed, only for the renovation and part of the incidental costs did I terminate a building savings contract or took out a certain amount via the resulting building savings loan.
