Hello everyone,
this year I moved into a semi-detached house (new build) on a corner plot. On the side of the plot there is currently an 8m wide plot, where according to planning, a side street will probably be constructed in 2017. Between the house and the 8m wide plot I have a 6.5m to about 7.5 - 8m wide plot (the plot boundary runs diagonally).
The development plan states that a garage must have a distance of 5m and a covered parking space 1.5m from the public traffic area. However, I would like to build a double garage or garage/carport combination at the boundary (which, as mentioned above, runs slightly diagonally).
Now to my actual question - there is still no public traffic area there. The municipality has already canceled the construction of the road several times in the past (no money) and postponed it to the future. If I were to get approval for my project and start it now, but at some point the road is built there - what is the situation then? Does the principle "first come, first served" apply, or would I then have to tear down or pay a fine?
Unfortunately, I found no information on the internet about such a case. I would be very grateful for experiences and tips. Thank you very much.
