Disposal of excavation material without pollutant testing/proof, soil class

Hello,

today during a consultation with a solid house company we received the information that we should have our soil report conducted with [LAGA Prüfung] (contaminant testing).

If we then have to dispose of excess excavated soil at a landfill, they set a certain price per ton depending on the soil composition. If we cannot prove the soil composition (contaminant testing), the most expensive price per ton is always charged (as if we wanted to dispose of contaminated excavated soil).

How was it for you? Is this statement correct?

The contaminant testing would cost us 400€ in addition to the 4 soil drillings.

The statement is correct, moreover it should be said that a landfill only accepts a certain amount (in our case 70sqm) without a Laga examination. Everything is only accepted if the corresponding examination has been carried out....

Thank you for the answer! How big is the price difference between disposal without a Laga examination and with a Laga examination? The note about the maximum amount accepted without a Laga examination is very helpful! We can hardly estimate how much actually needs to be removed. The base slab will be about 9x9 meters and we will fully basement with a height difference of 2 meters over a 30 meter long plot. We assumed that we could use most of it for refilling or filling to compensate for the slight slope.

Without Laga, no one will take it from you in the corresponding quantity... Because no one wants to have, for example, 200 cubic meters of heavily contaminated material deposited on their landfill... And with you, 9x9x2.3 is already at least 190 cubic meters...

That means it would actually make sense to tell the already commissioned soil expert to include the contaminant test for 400€ more right away.

But be careful! I don't know if this applies everywhere, but for us the report may be a maximum of 6 months old! This gets really tight from the soil investigation to the final determination of the "remaining quantity" after backfilling and modeling. We were offered 450€ for the subsequent [LAGA] investigation, so it basically costs the same regardless of the timing.
