Dirt on the neighbor's balcony; construction defects due to no drainage?

Hello,

our condominium (Neu) has balconies without water drainage. The balconies have a relatively steep slope, so water and dirt flow/fall onto the lower balcony and remain there. With wind, potting soil and earth from the roof terrace also accumulate. Depending on the apartment, pets and small children live there as well, whose dirt, and through play, very quickly get onto the lower balcony. In addition, the balconies are very difficult to clean because tiles with a very rough surface are installed. The first apartment ultimately has the problem and complains to the landlord about it. Can he even be responsible for this? Or does he have to do something about it? Is this a construction defect?

Interesting question.... we are just as annoyed about the constant trash and stuff from the neighbors above us on our terrace because they are prefabricated balconies and there is a very large gap between the floor and the railing or fall protection. Personally, I am more concerned about the danger of heavy objects or knives/forks falling down... our child plays on the terrace and I always have to make sure that he is not sitting directly in the area under this gap.

Interesting, we had to sweep garden stuff away from the neighbor for years. They have now created a rock garden.

If the homeowner had it built that way, then of course he is responsible for it. No, he doesn't have to do anything about it. But he could certainly address the phenomenon. Satisfied tenants are worth a lot. No, this is not a construction defect, but simply standard for balconies with open railings. Different problem. This gap is standard and not a defect. The acute concern that something could fall on a child’s head on a balcony below is new to me. random!!!

I never said it was a defect....it's just generally bad. Only that this danger is new to you surprises me. Especially the kids from above deliberately throw all sorts of things through this gap. But even an adult can accidentally drop something through it. For example, they also have their grill right by the railing, and if someone is handling it there, a knife or something similar can fall down. If someone is staying in the area below, a rag is not a big deal, but a hard object or, for example, a knife definitely is.

I am probably from a different parent generation with a different approach to life risks and event probabilities. Our boys climbed trees in the forest and already moved freely by bike in the small town at elementary school age to meet friends. At least, we understood the thing with the bike helmet 15 years ago.
