Development Plan vs §34 Symbols and Lines

Hello,

my question concerns the reading of development plans.

We have visited an interesting developed property (Bavaria). The attached excerpt comes from a development plan for an area near the property. There does not seem to be a development plan for the property itself.

I am interested in the meaning of the lines on which I have placed the blue arrows. Are these some kind of building line/building boundary, or do they indicate something else?

In the future, I might like to extend the house with a larger conservatory above this line, or a covered pergola in the garden, and of course I would like to know whether this might be excluded by this line. Since we are not yet sure whether the house/property is even an option, I did not want to make an appointment at the building authority just yet.

Yes. The lines come from the cadastral map and separate areas of different usage, here residential building area and garden land. This reflects the actual usage at the time of the last survey update. Since the development plan seems to be old, they might no longer represent the current status. Regardless, they have no planning law significance.

If it actually concerns an unplanned inner area (§34 Baugesetzbuch), one might recognize factual building boundaries, which happen to lie near the usage type boundaries (rear building lines). The conservatory could therefore be problematic, the independent pergola rather not. A preliminary discussion with the approval authority could help; only a building enquiry creates legal certainty.

Generally speaking: if you find plans but no legend for them, a look at the plan drawing regulations valid at the time of the development plan will help you. These do not change very often – only some older plans are still in "non-color".
