Good morning everyone,

I was under the impression that owner-occupied residential properties cannot be depreciated.

Has something really changed here?

"The 3% depreciation for owner-occupied properties is a new regulation introduced in connection with the Growth Opportunities Act in Germany. It is intended primarily to create incentives for new residential construction and applies from January 1, 2024. Here are the main points:

Requirements













Use of the property The depreciation only applies to owner-occupied residential properties.
New construction It must be a property completed after October 1, 2023.

Further down in the article it says:

Can I deduct the costs for an owner-occupied property for tax purposes?
Basically, the costs for owner-occupied living space are not tax-deductible. However, there are exceptions, especially for certain works (e.g. craftsmen services, energy-efficient renovations) or new buildings from 2024 with the 3% depreciation.

No idea who then came up with that nonsense. Too bad, I would have been very happy.

The text in the source is also quite confusing. Sometimes it is about properties built before 1925, sometimes about new buildings, etc.
