Delay in the preparation of a soil report

We were informed on 27.07. that the soil survey had been commissioned. On 13.08.2012, we were told that the soil survey had not yet been done because on 2 other plots, which are building with the same company, there is still too much earth. Honestly, I wonder, so what? Just because I am unlucky that my neighbors are also building with them, do I have to wait for them, even though if there were no neighbors, it would have gone faster for the same money. While the others eventually received their soil survey and the planning progressed, I heard nothing. Only after my insistence was it determined on 10.09.2012 that my soil survey had been forgotten. So 6.5 weeks for the soil survey. If I had taken care of one myself, it would probably have gone faster. Due to this oversight, my planning meeting was conducted relatively late compared to my neighbors. Although this was another loss of 3 weeks. In summary, it can be said that the soil survey, for which the company was responsible, caused me between 6 and 9 weeks of time loss, thus also delaying the start of construction this year (the builder said that construction will not start this year). This then leads to even more time loss and, due to longer double burdens of rent / interest (estimated 4 months), also a financial loss.

In our contract, it states the latest date by which construction must begin, and from then on the construction time guarantee applies. Is there something in your contract?

It says with us that the construction time guarantee begins with the start of construction. The entire lead time is not regulated. But the fact is, they were responsible for it, it was forgotten, they didn't even notice it but I did, and these are now the weeks that I am missing for this year.

So? Have you also made a written time agreement with the ground layer? If yes: Then document the damage and sue. If no: continue with the construction madness and don’t let yourself get annoyed by such things. Remember: Always stay on the ball, the phone is your friend, never be put off, never accept formulations with “calendar weeks”, never accept formulations like “some date we start” but set deadlines and include penalties in the contracts.
