Yes, the regional differences in the state building codes are really hard to understand. Therefore, I wonder if an architect who designs for many different federal states can still keep track. ;) Ultimately, she is responsible for the submitted planning. We are now having her continue planning with less roof pitch. On the one hand, to be on the safer side regarding the permissible floor area, and on the other hand, because we like it better visually. Let's see how the walkable attic likes that.

I also find 45° roof pitch borderline; depending on the perspective, it can already be perceived as rather sharp. Even 42° feels noticeably more subtle. Forty instead of forty-five degrees means here almost 73 cm lower at the ridge. Am I reading nine point five meters correctly as "Gussek Haus"?

Oh, 73 cm less height. The walkable attic does not like that at all! No, not Gussek House, we are planning with ECO House.

I have one more question about this. Let's assume our "building application" (in our case approval exemption) does not pass because the living area on the upper floor is actually too large. Who is legally "responsible" for this? By signing the building application, do we take sole responsibility? What matters to me is that in case of a problem, we do not have to pay the construction company for the structural changes, recalculations, redesigns... Actually, we rely on them, or the employed architects, being the experts and fulfilling and considering the regulations according to the development plan in our building application.

The "risk" of having the application rejected due to non-fulfillment of a framework condition does "unfortunately" not exist with the exemption. Compliance is NOT checked but confirmed and assumed by you and your plan drafter. The "certificate of clearance" only exists with the "major" application.

In the case of an exemption from approval, the builder bears the responsibility. That is why it is better to submit a building application if something is unclear or borderline.
You and the architect bear the responsibility for the correct compliance with the building regulations.
If you mess it up, there will be a building stop without discussion.
