Costs for soil replacement after soil survey before land acquisition

Hello everyone,

we have an approval/agreement from the city that we are allowed to conduct a soil survey before purchasing the property since I said that I want to know the possible additional costs from the outset so that they can be planned for.

Now we already have 2 soil surveys from neighbors, and for the directly adjacent neighbor, the drilling was stopped at 3 and 3.5 meters respectively due to solid rock. It later emerged that there were backfills with concrete blocks here which had to be completely removed due to compaction, resulting in approximately €17,000 in additional costs for soil replacement.

Now to the actual question, how do you see the chance that I can transfer the costs to the city? Is the seller of a property responsible to ensure that I can build on it without such additional expenses, or does this responsibility lie with the buyer?

Bad to very bad would be my assumption. The city will tell you that this is already included in the purchase price. Still curious... what was there before that someone disposed of construction debris?

Well, the prices are the same throughout the entire area, but there is only one section where the deposits are.

Back in the GDR times, there used to be a storage hall for agriculture here, and the large concrete pillars were allegedly crushed and mixed in here.

A chemical examination might then also be advisable... not that the tractor on your property has always had its oil changed.

the costs are borne by the property owner. So, no, you cannot transfer the costs. Is there a recording as [Altstandort] or [Altlast] in the property area or adjacent? The filling thickness is large. What does the investigation according to [LAGA] say?

The owner is still the city. I have already requested an old contamination excerpt, everything is green here. In the soil survey, chemical elements are also examined because arsenic is elevated in our Erzgebirge region.
