Hello!

We own a corner property that borders a street with a sidewalk at the front, for which we are naturally obligated to perform winter maintenance. On the side, there is a 60m long footpath, along which there is a city sign reading "No winter service." Adjacent to the sidewalk along the length that concerns our property, there is also a multi-family house and a community garden association (KGV). This was our first winter in our own home, and there was only one time when snow needed shoveling. No one shoveled the sidewalk—neither we, nor the KGV, nor the multi-family house.

My question (a written inquiry to the city is in progress, but the answer has unfortunately not yet been received): According to the city’s statute, we would also have to clear the sidewalk; however, there was nowhere anything mentioned in connection with such signs. But what about the KGV and the multi-family house? And do we have to clear it at all if the city has posted a sign there, or does that not apply to us? Maybe someone here knows. On the one hand, we obviously don’t want to unnecessarily shovel 60m, but on the other hand, it could be expensive if someone falls. And to what extent the winter service is shared with the other neighbors is also not clear to us. Unfortunately, we don’t know the respective owners.

Thank you!

I read that as an indication of a kind of "residents' path," i.e., it passes by your place to the other house and the allotment gardens, but it ends there without a connection to another street. "Kein Winterdienst" is an official warning sign about the danger for the user, and "kein" is absolute. That means it does not just indicate that no street sweeper comes, but that you do not either.

No, the sidewalk is a passageway that continues for about 100 meters. The sidewalk is municipal and open to pedestrians and cyclists. I have been told that it used to be a small street. There is relatively heavy pedestrian traffic there in the mornings and afternoons, especially dog owners and parents with children, as it is a shortcut to the park.

So, if the city puts up this sign there, does that mean we don't have to clear anything there either? Unfortunately, I can't find any information about this on the internet. I hope the city responds soon; we need to know by next winter at the latest.

That means first of all: anyone who can read the local official language knows that nothing is cleared there. As long as there is no additional sign saying "except by Winniefred," this also applies to you. In case of doubt, it's best to ask your lawyer. If you ask the city too many questions, they might end up introducing a municipal winter service and charge the residents for it.

And put a photo somewhere before the sign grows legs.

The sign is of course only valid as long as it hangs there. If the municipal council adjusts the classification of the path to its actual usage, it will be removed.
