Control visits for landlords - Right of entry

Hello,

we have now been living in the new apartment for 6 weeks. Unfortunately, our landlady (who lives above us) is becoming more and more annoying. Recently, I installed a shelf in the kitchen and therefore had to drill. Not even 2 minutes later, the doorbell rang. She was standing at the door – put her foot in it and wanted to see what I had drilled. I refused her this. She then argued that she is the owner and has the right to do so. I replied that she does not have that right. This has already happened once – she simply barged into the apartment. In any case, she then left grumbling and came back 10 minutes later with (to me) a male companion. I did not open the door then, after which she rang the doorbell for 5 minutes. My question: is there a paragraph or something similar that I can show her?

Hello aana,

The landlord undertakes through the lease agreement to make the apartment available for your use, which also includes the right of domicile. However, the landlord is allowed to inspect the apartment for certain purposes; for example, if the need for renovation work is to be determined, or if the inspection is important for the sale or re-rental. These inspections must also be announced in a timely manner. Simply wanting to look around anytime is not a reason to restrict your right of domicile in the rented apartment.

In the Code of Obligations (The Lease, Art. 253 to 274g CO) you will find articles that match your question: Art. 253 and Art. 257h

Right of visitation in the GTC

Hello, in the general terms and conditions there may be more related provisions.

The HEV/SVIT/VZI-GTC stipulate a right of visitation with prior notice (48 hours in advance).
