I am aware that the money will be very hard to get. But the possibility exists

If he can definitively prove it, I think yes: he can.

I am currently waiting for ceilings. A factory was closed due to Corona... that probably should not count towards the construction time guarantee. Neither do the 3 months of waiting before because there was groundwater in the construction area and no frost skirt could be poured...

But I also understand that, honestly. What is he supposed to do, if there is no material, there is none.

If I order a PLC today, it will arrive in September 2023. I also depend on my customer understanding that I am not intentionally leaving him hanging. I just don’t get the material...

Realistically, this possibility only exists if the developer is very lenient. In court, the costs will consume it.

1,400 EUR/week is a lot of money, the entire margin can quickly vanish.

Well, causing pain is the purpose of a penalty ;-)

It is a self-imposed penalty. And the general contractor only does this because he is very confident that he will never have to pay this penalty.
