Contractual penalty for sale/rental within x years

Hello everyone,

I have had the opportunity to purchase a building plot in our municipality for a few days now and am uncertain about the matter because the municipality demands a contractual penalty of 100 euros/sqm in case the plot is not occupied by the owner for at least 10 years after the completion of the building. Since in this particular case it is about around 600 sqm of building land, this would be a considerable amount of money in the worst case.

Of course, I want to move into the house to be built myself later and do not plan to resell within the next 10 years (otherwise I would hardly go through the huge effort of building), but who knows what eventualities the next x years will hold.

I would therefore be interested to know whether you had similar requirements from the municipality in your land offers, what they roughly looked like, and whether they ultimately deterred you from purchasing. Maybe there is also a case of someone who had to pay the contractual penalty in full or in part.

Addendum: I did not choose the thread title quite correctly, I don't know how to change it afterwards: basically, the contractual penalty applies if the property is not self-occupied within the first 10 years after completion. This of course includes both selling and renting out the property, for example, in the case of a job-related relocation.

I don't know it like that, here it runs as a building obligation, it must be built on within three years.... But that makes sense to prevent speculation. If you have money or are a developer, you would otherwise simply acquire 10 plots and build on them, then sell the huts with a 50% markup. This is stopped here. Therefore, a more sensible move by the municipality. Says Karsten

Yes, we do have that too. But not that high. I believe only 10,000 euros.

These plots of land are often sold at a discount (below market value) by the municipalities. The penalty payment is then intended to compensate for the difference in order to prevent speculation.

In my case, the price per square meter is about 50 euros above the current [Bodenrichtwert].
