Commitments from the construction manager - Trust relationship

Hello everyone,

I have a question about commitments from the site manager. The site manager is employed by my construction company, so he is employed there and my primary contact person.

We had a complaint about the ceiling because the gypsum boards were not properly installed. The site manager agreed with this. Since we wanted to complete the work quickly due to the move-in date, we asked the site manager if a local company could do it.

We therefore obtained a quote and presented it to the site manager, who approved it, and we commissioned the company. But now the construction company does not want to pay the amount and is blaming the site manager for exceeding his authority....

What can I do to hold the company accountable, after all the contact person was the site manager and thus the construction company 1:1 for me. He fairly told his company that everything was correct and that he allowed me to have the remedial work done by an external company.

The construction company itself is being uncooperative and says that the site manager has to settle it with me directly and they are off the hook...

But this is a relationship of trust, and the site manager is employed by them; they cannot just shrug this off, can they?

Hello,
Wrong! The contractual partner is always the home construction company. The site manager is merely their employed vicarious agent. So he also acts in their name/on their behalf!
If discrepancies arise here, the resolution is the responsibility of the construction company, not the client!

And why is the relationship with the site manager now strained? He made a mistake and now has to take responsibility for it. A construction company always has the right to correct mistakes. If you hire an external company, you just have to pay for it. If the site manager commissioned it, he would have to pay. However, that would be quite unfair of you. Everyone makes mistakes sometimes, and letting him suffer alone now would not be very fair. How much is the amount? It can't be that much... I would say, pay it and that's that.

Read carefully? I commissioned the external company after I coordinated it with the site manager. He looked at the offer and agreed to it, saying yes, his house construction company would pay for it. So why should I let him bleed? He is acting on behalf of his company. He probably overstepped his authority because supposedly he shouldn’t have told us about it.

In my eyes, he acted correctly because he reacted quickly and competently. But his company is now leaving him and me out in the cold and says the site manager has to settle that with them.

And that’s what I mean can’t be. The house construction company should be responsible for that since he is their employee. I didn’t ask the site manager “before” commissioning for nothing, precisely to avoid difficulties.

Why should I pay for that??

I see it the same way. Let's see what happens; I am writing to the managing director today. I just find it unprofessional that I am told I have to clarify this with the site manager. As you rightly say, he acts on their behalf.

Hello, is there a defect report or anything in writing stating that a defect exists that needs to be repaired, or were these verbal agreements? Best regards
