Civil engineering/Earthworks: Twice as many tons as offered*

Hello everyone,

I'm not sure if this is the right forum.

According to the soil report, we had to excavate 0.80cm and fill with frost protection gravel.

Now we have received the invoice and are very surprised because the tonnage is much higher.

163 tons were quoted.

Material: Mountain gravel (0-45 I estimate)
16.10m x 12.00m

In the calculation, it is now 375 tons. And that even though the site manager said it was a great soil.

That can't be right, can it?

Please respond as soon as possible.

The excavation is almost 160 m3
that corresponds to about 240 tons uncompressed
+ 15 for compaction are approximately 275 tons

Is the foundation pit 16 x 12 m or the base slab?

Thanks for your reply. The base slab is 9.37x10m something.

I have received all the weighing slips. And they are correct so far.

Who has fooled whom now? And what can I do if the construction company won't be moved?

One more question in this context:

They also laid natural stone gravel. I assumed it would only be stones. But there is a lot of soil in between. Is that normal?

Commissioned according to VOB? Commissioned based on the quantity in tons? Then you're pretty much out of luck. Commissioned based on the dimensions of the excavation pit? Then you need to ask a construction law lawyer what is possible. Additional quantities usually do not have to be reported.

If the actual installed quantity deviates by more than 10% from the offered quantity, however, you can demand an adjustment of the unit price (price /m^3). Abs. 3 VOB/B How much that brings, presumably not much.
