Hello,

I have a question regarding the draft plans from a construction company.

Let's assume Company A creates a draft plan of my house for me.

Company B also creates a draft plan for me.

However, I would now like to build with Company B, using the plan from Company A.

The question is, am I allowed to pass on these plans?

Or rather, not the entire plan, just the scanned house without any additional data.

So that Company B knows exactly what I want.

So only the floor plan would be depicted, no measurements or other data.

I just think that it might be about the UrhG, after all, the draft does not come from your mind. Even if it were allowed, I consider it morally reprehensible for myself to simply present drafts that someone has put thought into to someone else in order to gain advantages from them. But that's just my personal opinion.

A floor plan itself is definitely not protected by copyright. You could also neatly transfer the floor plan onto a piece of paper and go to your company B and have it built there. Or is it about finished execution drawings? Usually, such things are not available in the bidding phase. There are hundreds of thousands of floor plans on the internet, and sooner or later they repeat somewhere. Our construction company also said back then that their floor plans for the fully configured houses are constantly copied. Otherwise, you could change some small detail, and then it is no longer the floor plan of company A.

Even a floor plan can be a work of creative height.

Certainly not the standard plan that you find with every BT or GU, but every individual design can constitute claims under the Copyright Act.

I would therefore be at least cautious.
