Building notification, do you still get a written permit?

Hello,

we have an approved development plan. This means we have submitted a building notification and received confirmation that if we do not receive a rejection within 4 weeks, we can start construction.

But how am I supposed to prove, if necessary, that I have not received anything from the office? I mean, how can you prove something you don't have?

Or will they send a permit afterwards?

Hello,

You are in the so-called exemption procedure – then no separate confirmation from the building authority (BA) that the application is approved is required. If you do not receive any contradictory notification within 4 weeks, you can start construction from that date.

If you want a notification, you would have had to indicate that on the application.

we also built in the [Freistellungsverfahren] and still received the "grünen Punkt."

Unfortunately, I have to bring up this topic again. We also submitted a building application through the exemption procedure. When I handed it in, the clerk said that we would only get the stamp starting tomorrow. (Officially, it was only allowed to be submitted as of the 1st.) Until last week, we had not even received a confirmation of receipt, so I called again. The lady then told me that they generally do not send those out. Hmm. Unless stated otherwise, I am allowed to start after one month. But how am I supposed to prove that if I don’t even have proof that I submitted the building application? Do you have any experience with this? Thank you very much!

The date stamp is extremely important in case of legal disputes.

There have already been curious cases here in the forum, but if you want to be on the safe side as a builder, you need proof of upload (in the case of an electronic process) or the date stamp.

It is enough if you go there and photograph and/or copy the cover sheet with the authority's date stamp, whereby the office should also confirm the receipt upon request.
